legal Rules that you must be aware of

 

‘Ignorance of law is no excuse’ is an oft repeated phrase. As citizens of this country and city we


must be aware of the legal rules. The city of Chandigarh is governed by a civic administration or local government headed by the Municipal Commissioner and the mayor. The city comprises of 26 wards represented by 26 elected councilors, and 9 nominated councilors.

Through this blog I will enlighten you about the civil laws applicable to Chandigarh. And don't miss the traffic rules!

Let’s start by something simple.

 

1) Right to education- Right to education๐Ÿ“• means that education is a fundamental right of every individual๐Ÿ‘ฉ and it is the government's responsibility to ensure that individuals are able to exercise their right.

All schools๐Ÿค are required to reserve 25% of the seats for the economically weaker section (EWS) of the society. And everybody has the right to be educated between the ages of 6 to 14 years. This law is not only applicable in Chandigarh but in the entire country.


 2) Defamation- Defamation means injuring a person’s character, fame, or reputation by false and malicious statements and communicating the same to a third party๐Ÿ‘ช.

ESSENTIALS OF DEFAMATION

·       The statement made must be defamatory.

·       The said statement must refer to the claimant.

·       The statement must be published that is it must be communicated to at least one person๐Ÿ‘ค other than the claimant.

For example: You write a statement against someone so as to injure the person’s reputation on a group chat of a social media platform like Whatsapp๐Ÿ“ฑ, it will be considered as an act of defamation. This is because more than one person can view that statement and this causes injury to the reputation of the concerned person๐Ÿ’€.

This is both a civil wrong❎ and a tort and any person defaming another is liable to compensate him for the injury to his/her reputation.

 

3) Civil Disputes- A dispute is a continuing disagreement carried on between two or more parties๐Ÿ‘ฏ. The parties may be people, or they may be organisations or countries. Disputes can last a long time, and they can have serious results๐Ÿ˜จ. A dispute may arise due to any controversy and may eventually turn into a full-blown conflict.


For example: You plan to buy someone’s car๐Ÿš“ but then you don’t pay๐Ÿ’ฐ the entire amount for the car which you had promised to the seller. This will lead to a dispute between the buyer and seller. Another eg., is where a tenant refuses to pay rent to the landlord๐Ÿ‘ณ; the landlord has a right to seek relief from the court. These disputes are civil in nature.



Property tax - 
Property tax is a charge that the owners of real estate are bound to pay to the Government. The tax is collected either by the local governing bodies or by the Municipal corporation of a State. A property tax is charged on all kind of real estates, whether residential or commercial and whether self-owned or rented out.



Water Tax
- Water used in Government/Semi-Government offices shall be charged @ Rs. 25.00 per Kilolitre. Water used in Industrial/Semi Industrial/ Commercial establishments/ for construction/renovation shall be charged @ Rs.  30.00 Per Kilolitre.





Traffic laws: One of the primary responsibilities of every citizen is to have proper knowledge important traffic rules and regulations that are in place in the country, regardless of whether they are in the driver’s seat or not. Road rage is one of the main causes of undue disturbances in our country today, and traffic congestions are a well-known issue throughout. The traffic police across the country are doing their best to combat this situation, mainly through the implementation of stringent rules and regulations that draw fines or punishments for the offences. The traffic police of Chandigarh has put in place several rules and regulations to do their part towards the prevalent situation. 

 

4) Traffic rules-


i)               Hurry up fasten that seat belt of yours!!๐Ÿ’บ


Seat-belts have proven to be the most important safety device in cars as it dramatically increases the chances of survival of the occupants in the event of an accident. It has been estimated that seat belts reduce the risk of death for a front seat car occupant by about 50%!


ii)              I dare you to smoke when you are riding any vehicle!!๐Ÿšญ

No driver of a motor vehicle shall smoke while driving the vehicle, since it can cause danger to the public.


iii)           Wear your helmet or get challaned!!๐Ÿ‘ฎ

    A safety helmet is the most important item of personal     protective equipment used by motorcyclists to protect their head against impact. In the year 2003 there were 72 deaths of two-wheeler drivers/pillion riders due to road accidents in Chandigarh. The number of those injured would be at least ten times this figure If these individuals had not been wearing helmets!


iv)            Put that phone down right now!!๐Ÿ“ด

No driver of a motor-vehicle shall use or answer the cell phone  while driving the vehicle.


            v)              Don’t jam those drinks down your throat or you are in trouble!๐Ÿน

In India, any person having in his blood, alcohol exceeding 30 mg per 100 ml. of blood as detected in a test by a Breath Analyzer, or being under the influence of a drug to such an extent as to be incapable of exercising proper control over the vehicle is punishable. He/she can be imprisoned up to 2 years  and/or fined up to Rs. 3000/.  Moreover the legal drinking age is 25 years in India.


vi)            Don’t drive if you are underage else you will be in grave danger!๐Ÿš“

You cannot drive a vehicle if you are underage that is less than 18 years or if you don’t have a driver’s license.


vii)          Don’t you jump the traffic light!๐Ÿšฆ

Never jump a red light since you could endanger yourself. Moreover who wants to unnecessary money to the cops.

Second-Time Offence: Rs.4,000 and/or Imprisonment of up to 3 months.
Rs.1,000 and/or Imprisonment of up to 3 months.
